TERMS OF SERVICE

1. ABOUT BLUSH & BLOOM

Blush & Bloom is an Australian-operated online fashion retailer based in Queensland, Australia. We curate products supplied by third parties. Products may be dispatched directly by fulfilment partners, including partners located in China. We do not operate a public physical storefront.

This website and its checkout are powered by Shopify. Purchases made through this website are transactions with Blush & Bloom, not Shopify.

2. ACCEPTANCE OF THESE TERMS

By accessing this website, creating an account or placing an order, you agree to these Terms of Service and the policies referenced on this website. If you do not agree, do not use the website or place an order.

You must be at least the age of majority in your jurisdiction, or use the website with the consent and supervision required by law.

3. INFORMATION YOU PROVIDE

You agree to provide current, complete and accurate account, billing, payment and delivery information. You are responsible for maintaining the confidentiality of your account credentials and for activity conducted through your account.

4. PRODUCTS AND PRODUCT INFORMATION

We aim to present product descriptions, dimensions, materials, colours, images, prices and availability accurately. Screen settings and manufacturing variations can cause minor differences in colour or appearance.

Products are sourced from third-party suppliers and are not manufactured by Blush & Bloom unless a product page expressly says otherwise. Supplier and fulfilment arrangements may change without affecting the essential characteristics of the product.

We may correct inaccurate information, update a product description, limit quantities or discontinue a product. If a material error affects an order already placed, we will contact you and provide the options required by applicable law.

5. ORDERS

Placing an order is an offer to purchase. An order is accepted when we issue an order confirmation and successfully process payment. We may decline or cancel an order where permitted by law, including for suspected fraud, an obvious pricing error, unavailability or an inability to deliver to the address supplied. If we cancel a paid order, we will refund the affected amount.

Review your order carefully before submitting it. Cancellation requests should be emailed promptly to blushbloomfashion@gmail.com. Orders can normally be cancelled only before fulfilment begins.

6. PRICES, PAYMENT AND CHARGES

Prices are displayed in the currency shown on the website and are subject to change before an order is placed. The checkout will show the product price, available shipping charge and applicable taxes collected by us before you confirm the purchase.

International orders may be subject to customs duties, import taxes or fees charged by the destination country. Those charges are the customer's responsibility unless checkout expressly states that they are included.

You confirm that you are authorised to use the payment method submitted with an order.

7. SHIPPING AND DELIVERY

Orders are normally processed within 2–5 business days. Australian delivery is estimated at 7–15 business days after dispatch, or 9–20 business days from order to delivery. International delivery is estimated at 10–25 business days after dispatch, or 12–30 business days from order to delivery.

Products may be sent directly by different fulfilment partners, so one order may arrive in separate packages and on different dates. Delivery times are estimates and can be affected by carriers, customs, weather, public holidays and other events outside our control.

8. RETURNS, REFUNDS AND CONSUMER GUARANTEES

Returns, cancellations and refunds are governed by our Return and Refund Policy. Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded, including rights under the Australian Consumer Law.

9. INTELLECTUAL PROPERTY

The Blush & Bloom name, logo, website design and original website content belong to Blush & Bloom or are used with permission. Product images, descriptions, trademarks and other supplier materials may belong to their respective owners.

You may use the website for personal, non-commercial shopping purposes. You must not reproduce, republish, sell or exploit protected website content without the rights holder's permission.

10. ACCEPTABLE USE

You must not use the website to break the law, infringe another person's rights, transmit malicious code, interfere with security or operation, collect personal information without authority, impersonate another person or submit false or misleading information.

We may restrict access or cancel an account where reasonably necessary to protect customers, the business, Shopify or other service providers.

11. THIRD-PARTY SERVICES AND LINKS

The website may use services supplied by Shopify, payment providers, carriers, fulfilment partners and other third parties. Third-party services and websites may have their own terms and privacy practices. Blush & Bloom remains responsible for its obligations to customers and does not use a third-party arrangement to exclude rights that apply by law.

12. PRIVACY

Personal information is handled in accordance with our Privacy Policy. Shopify and other service providers may process information to operate the store, payment, fulfilment, analytics and customer-support services.

13. REVIEWS AND FEEDBACK

If you submit a review or other feedback, you confirm that it is truthful, based on your genuine experience and does not infringe another person's rights. You permit us to display and use that feedback for operating and promoting the store, subject to applicable law and our Privacy Policy.

14. WEBSITE AVAILABILITY AND ERRORS

We work to keep the website accurate, secure and available, but uninterrupted access cannot be guaranteed. We may maintain, update or temporarily suspend parts of the website. We may correct typographical, pricing, availability or other errors in a manner consistent with applicable law.

15. LIABILITY

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited. To the extent permitted by law, we are not liable for indirect or consequential loss that was not reasonably foreseeable and was not caused by our breach of a non-excludable obligation.

16. SEVERABILITY

If a provision of these Terms is found unlawful or unenforceable, that provision will be applied to the greatest extent permitted or severed, and the remaining provisions will continue.

17. GOVERNING LAW

These Terms are governed by the laws of Queensland, Australia, subject to any mandatory consumer law that applies in the customer's location.

18. CHANGES TO THESE TERMS

We may update these Terms by publishing a revised version on this page. Changes apply from the stated effective date and do not remove rights that already apply to an accepted order.
